GREYHAWK provided claims resolution and expert witness testimony associated with cost overruns on reconstruction of nine miles of roadway and bridge rehabilitation on a section of the Pennsylvania Turnpike. The contractor filed a $15.5 million claim alleging inefficiencies caused by unforeseen conditions, predominantly unsuitable soil requiring stabilization. GREYHAWK reviewed and responded to four claim reports made by the contractor and issued rebuttal reports to the Commonwealth of Pennsylvania Board of Claims.
GREYHAWK created a detailed as-built project schedule, outlining critical activities and cause-and-effect relationships to demonstrate that the alleged unforeseen conditions had minimal impact; rather contractor incompetence caused most of the cost overruns. GREYHAWK reviewed the damage claims and demonstrated that the contractor’s total cost method used for damages was inappropriate. GREYHAWK concluded that the contractor was entitled to some compensation for legitimate reasons. Due to GREYHAWK’s efforts and its expert testimony, the board ruled in favor of the Turnpike Commission, granting a mere $40,000 of the original claim in a verdict that withstood appeal.
