GREYHAWK provided termination evaluation, schedule delay, and cost damages analysis associated with construction of a new 46-unit assisted living facility, originally named Lutheran Care at Moorestown.

GREYHAWK’s involvement began with assistance in Lutheran Care’s contemplation of terminating the original contractor due to project delays. Upon the contractor’s termination, GREYHAWK tracked costs associated with rework, project completion, and additional work related to the contractor’s performance. During the subsequent termination-related dispute, GREYHAWK performed a detailed construction claims analysis, including developing an as-built schedule, identifying the as-built critical path to project completion, and identifying, quantifying, and assessing responsibility for critical delays. GREYHAWK also performed a comprehensive damages analysis quantifying additional costs the owner incurred as the result of the contractor’s performance and termination. Due to GREYHAWK’s consulting, the claim was resolved with an out-of-court settlement in which Lutheran Care recovered an amount sufficient to cover completion and final construction costs inclusive of rework.
