GREYHAWK provided schedule and cost damages analysis to Sica Industries, Inc. (now Sica Modular Homes) for the construction of four two-story modular duplexes in the Borough of Lavallette, New Jersey.
Sica entered into four construction contracts with a combined value of $2.1 million for the erection/construction of four duplexes. Although the contracts did not indicate that time is of the essence, they did establish a rough timeframe of four months for construction of each duplex, along with an approximate substantial completion date. None of the duplexes were completed on schedule. In order to maintain the planned construction schedule, the owner was required to provide for certain utility connections and to select various flooring and finishes for each unit. Sica argued that the delays were the result of the owner’s failure to make decisions in a timely manner. The owner claimed that it was Sica’s failure to timely progress the work that delayed the project. The dispute resulted in binding arbitration.
Sica engaged GREYHAWK to perform a detailed construction claims analysis, including the development – for each unit – of an as-built schedule, identification of the as-built critical path to completion, identification and quantification of critical delays, and assessment of responsibility for the delays. GREYHAWK also performed a cost damages analysis quantifying Sica’s damages associated with the delays at each duplex and provided expert testimony at the arbitration, in which Sica ultimately prevailed.
