GREYHAWK provided schedule delay analysis consulting to Canyon Building & Design, LLC, related to modular construction of a 92,000-sf charter school in Brooklyn, N.Y.
Canyon entered into a design-build contract for a new, five-story charter school. Floors two through five and the rooftop penthouse were of modular construction. For the modular portion of the work, Canyon entered into a $10 million subcontract for the offsite construction and delivery of 160 modular units and related components. The rigging and erection of the modular units would be performed by Canyon with supervision by the modular subcontractor. A module delivery schedule was developed based on the erection sequence required for timely and efficient project completion before the start of the school year. However, module delivery commenced one month later than planned and was completed four months later than planned, a month after the start of the school year. Additional issues arose during construction, which impacted Canyon’s ability to complete structural and building system tie-ins, achieve a weathertight building, and complete interior finishes. As a result, the project was completed one year behind schedule.
GREYHAWK was retained to discretely identify and quantify the critical delays experienced by Canyon, assign responsibility for each critical delay, determine cost damages as a result of those delays, and determine the cost to address any deficiencies. GREYHAWK prepared an expert report and provided testimony during deposition, resulting settlement before trial.
