The Philip H. Tollefson Mesa Water Treatment Plant was built in 1942 in Colorado Springs, Colorado; it originally had capacity to treat 6 million gallons per day. In 2018, Colorado Springs Utilities undertook an upgrade of the plant to increase capacity to 42 million gallons per day, including construction of new pretreatment and chemical injection facilities.
For construction of the upgrades, Colorado Springs Utilities entered into a $30 million contract that anticipated work being completed within two years. As a result of various issues that arose on the project, delays were experienced and additional costs were incurred, the responsibility for which was disputed between Colorado Springs Utilities and the contractor. Ultimately, the contract was terminated prior to completion of the work, and litigation was initiated to resolve disputes between the parties.
Colorado Springs Utilities engaged GREYHAWK to analyze the claims presented by the contractor, as set forth in the contractor’s schedule delay and disruption analysis; and to provide expert opinions and, if necessary, expert testimony in litigation, relative to GREYHAWK’s findings. In this regard, GREYHAWK prepared and submitted an expert report and gave deposition testimony. The case was settled prior to litigation.
